Terms of Use

  1. General

    1. This Reading Open Data Service website, its services and the data supplied via its APIs (“the Website”) are operated and controlled by Reading Buses (“we”, “us” our “our”).

    2. The primary purpose of the Website is to provide at no cost to external parties, information on buses journeys operated by us and our partners for non-commercial purposes.*

      (*If you want to use any information from this site for commercial use, you must contact Reading Buses to obtain explicit consent.)

    3. As a condition of using the Website to subscribe to data feeds via the provided APIs, you are required to register to create an account.

    4. Use of the Website is governed by these terms (“Terms”). By accessing the Website and registering to use the services provided by the Website, you are agreeing to the Terms set out below. If you do not accept these Terms you should exit the Website immediately and stop using any the provided services.

    5. As a condition of your use of the Website, you agree that you will not use the Website or any purpose that is unlawful or prohibited by these terms of use.

    6. We may at any time revise these Terms. It is up to you to regularly review the Terms in case there are any changes. Continued use of the Website after a change has been made is to be treated as acceptance of that change by you.

    7. If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, it will only do so in writing, and that will not mean that it will automatically waive any later default by you.

    8. If any provision or term of these Terms shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the other terms and conditions and shall be deemed to be deleted from them.

  2. Disclaimer

    While we try hard to ensure that the Website is functioning correctly and the information provided (“Content”) is as accurate as possible, this will not always be achievable and therefore the following disclaimer applies:

    1. The Website and Content is provided "AS IS" and on an "AS AVAILABLE" basis and neither us nor its suppliers of third party data guarantee its availability, accuracy, timeliness, completeness, performance or fitness for a particular purpose of the Website or any Content whatsoever. All implied warranties, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy are excluded from these Terms to the extent that they may be excluded as a matter of law. In particular, we do not guarantee or represent that the content and/or facilities available or accessible via the Website will always be accurate, complete or current or that access to the Website will be uninterrupted.

We expressly disclaim all liability for any direct, indirect or consequential loss or damage occasioned from the use or inability to use the Website, whether directly or indirectly resulting from inaccuracies, defects, viruses, errors - whether typographical or otherwise, omissions, out of date information or otherwise.

    3. Accessing the Website and the downloading of material from it is done entirely at your own risk. You, and not us, will be entirely responsible for any resulting damage to software or computer systems and/or any resulting loss of data even if we have been advised of the possibility of such damage.

    4. The information on the Website does not constitute legal or other professional advice.

    5. Hypertext links from the Website (“the Links”) exist for convenience and information, and we make no representations regarding, or accepts any responsibility or liability for the products, services or information (or any reliance on it) contained on any site connected by the Links. The Links are provided 'as is' with no warranty, express or implied, for the information provided within them. The existence of a link to another website does not imply or express our endorsement of its provider, product or services.

  3. Trademarks and Copyright

    1. All trademarks that may appear on the Website are acknowledged and are the property of their respective owners.

    2. Unless expressly stated the copyright and other intellectual property rights (such as, design rights, trademarks, patents etc.) in any material provided on the Website remains our property (or as the case may be another rightful owner). Our owned material on the Website including text and images, may not be printed, copied, reproduced, republished, downloaded, posted, displayed, modified, re-used, broadcast or transmitted in any way, except for the user's own personal non-commercial use.   4. Cookies

    1. The Website uses “cookies” to optimise your experience. These cookies do not identify you personally as they store no personal data and are not used to gather personal information. You have the choice to enable or disable the ODS cookies. It is recommended that you allow all cookies set by this site as they help us provide you with a better service. If you decide to delete or disable these cookies, then you may not be able to access certain areas or features of the Website.

  5. Modifications or Restrictions

    1. We may, at any time and without notice, suspend, withdraw, discontinue or change all or any part of the Website without notice. We will not be liable to you if for any reason the Website is unavailable at any time or for any period. Please note that any of the content on the Website may be out of date at any given time, and we are under no obligation to update it.

    2. We may, at any time and without notice, restrict or suspend your use of the Website, APIs provided, data (or frequency of data) supplied via the APIs if it is deemed and/or deactivate your account, in our sole opinion, to be excessive or affecting the performance, function or purpose of the Website.

    3. Unless explicitly stated otherwise, any new feature, content, products and services offered shall be subject to these terms and conditions.

  6. Unauthorised Use

    You must not:

    1. attempt to gain unauthorised access to, circumvent security, tamper with, hack into, or otherwise disrupt the Website, the server on which the Website is stored or any server, computer, database, router or any other Internet connected device connected to the Website;

    2. misuse our Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful; or

    3. attack our Website via a denial-of-service attack or a distributed denial-of service attack.

      By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990 and your right to use the Website will cease immediately.

      Furthermore, you must not:

      1. use the service for commercial purposes, without first obtaining our written permission; or

      2. misuse (in our sole opinion) or modify the information supplied by the Website such that it provides misinformation to third parties or harms our reputation, our business or that of our suppliers of third-party data.

  7. Privacy Policy

    1. We take your privacy and safety extremely seriously when using the Website.

    2. We will only collect the following personal and sensitive information (“Personal Identifiable Data”) from you

      1. at the time you register with us

        • name
        • email address
      2. during your use of the Website

        • your source Internet Protocol (IP) address

        that is reasonably necessary for us to operate the Website and provide to you the Website’s services.

    3. We will only use your Personal Identifiable Data for the following purposes:

      • to contact you to verify your identity, regarding changes to the Website, updating our Terms and your use or your registration; or
      • for the operation and optimisation of the Website and its services; or
      • for those other purpose which we state at the time of the collection, as permitted by law and/or as required to provide the functions and services you request.
    4. We will only collect Personal Identifiable Data by lawful and fair means and not in an unreasonably intrusive way.

    5. By providing the above details as part of your registration to the Website, you consent to their use and this forms our legal basis for collecting your Personal Identifiable Data.

    6. We will never share your data with any third party and your Personal Identifiable Data will never be used for marketing.

    7. When you access our Website, our servers automatically record certain information in the form of logs regarding your interaction with the Website (“Logs”). These Logs can be linked to your account (ie your email address and name which are part of your Personal Identifiable Data) and will include the following information:

      • your API requests and subscriptions
      • source IP address
      • registration data and activity
      • browser type and language
    8. Your Personal Identifiable Data and Logs will only be stored for as long as it is legal, appropriate and operationally necessary to do so.

    9. If at any point in time you wish to withdraw your consent with respect to the retention of your Personal Identifiable Data, please provide us with your written request to do so by emailing us at customerservices@reading-buses.co.uk. Note that in doing so, your account will be de-activated, and you will no longer be able to use the Website services.

    10. We reserve the right to de-activate accounts where there has been no activity for a reasonable period. We will notify you by email if we de-activate your account.

  8. Jurisdiction

    1. These Terms and any claims arising out of or in connection with them or the access or use of the Website shall be governed by and interpreted in accordance with English law and shall be subject to the exclusive jurisdiction of the courts of England and Wales.
